Terms of service

These Terms of Service (“Terms”) govern your use of the website and bail bond services provided by Vanguard Bail Bonds (“Company,” “we,” “us,” or “our”). By accessing our website at https://www.vanguardbailbonds.com or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our website or Services.

Important: These Terms are a legally binding contract. Bail bond services are regulated by state insurance departments, and your bail bond agreement is a separate contract that governs the specific terms of any bond posted. In the event of a conflict between these Terms and your bail bond agreement, the bail bond agreement controls for bond-related matters.

1. ACCEPTANCE OF TERMS

By accessing or using our website, submitting an inquiry through our contact or bail quote forms, or entering into a bail bond agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our website or Services.

2. ELIGIBILITY & AUTHORITY TO CONTRACT

Our Services are available only to individuals who are at least 18 years of age and who are legally capable of forming a binding contract under applicable federal, state, and local law. By using our Services, you represent and warrant that you meet these eligibility requirements.

In many states, including California and Minnesota, the arrested person, their attorney, or an adult friend or family member must initiate contact with a bail agent. You represent that you are authorized to act on behalf of the person in custody or that you are the person in custody, and that all information you provide is accurate and truthful.

You are 18 years or older

You are legally competent to contract

You are authorized to act for the defendant

You provide truthful information

3. DESCRIPTION OF SERVICES

Vanguard Bail Bonds is a licensed bail bond agency. Our Services include posting bail bonds on behalf of eligible defendants, coordinating with courts, jails, and detention facilities in California, Minnesota, and nationwide through our partner network, providing information about the bail process, offering flexible payment plans and financing for qualified applicants, and operating a 24-hour emergency service and an AI assistant available by call or text for general bail information.

We do not guarantee that any person will be released from custody. Eligibility for release is determined by the court, jail, or detention facility and may be affected by holds, warrants, immigration status, probation or parole conditions, or judicial orders.

4. BAIL BOND PREMIUM & PAYMENT TERMS

The bail bond premium is the fee charged by the bail agent for posting the bond. In California and most states, the premium is most commonly 10% of the total bail amount, plus any lawful and reasonable transaction expenses. Some states have different rates (e.g., 15% in Nevada, 12% in Georgia and Louisiana). The exact rate is set by the surety company and filed with the state insurance department.

Premium is Nonrefundable

The premium pays for the service of issuing and posting the bond. It is generally nonrefundable, even if charges are dropped or the case is dismissed.

Cash Bail is Different

If you deposit the full bail amount with the court, that money may be returned after the case concludes, subject to court rules. Bail bond premiums are separate from cash bail.

Payment plans, financing, and collateral requirements vary based on the bond amount, the applicant’s qualifications, and the surety company’s guidelines. All payment terms will be documented in your bail bond agreement. Late or missed payments may result in additional fees or forfeiture proceedings as described in your agreement.

5. CO-SIGNER & INDEMNITOR RESPONSIBILITIES

A co-signer (also called an indemnitor) enters into a financial contract with the bail agent and surety company. By signing the bail bond agreement, the co-signer assumes responsibility for: paying the premium and any agreed payment plan in full; ensuring the defendant appears at all required court dates; keeping the bail agent informed of address or contact changes; paying any additional fees or expenses if the defendant fails to appear; and protecting and surrendering any pledged collateral upon forfeiture or request.

This is a serious financial obligation. You should read the entire bail bond agreement before signing and request a copy for your records. Do not sign any blank or incomplete forms.

6. COLLATERAL & FORFEITURE

Depending on the bond amount and the applicant’s qualifications, the bail agent may require collateral. Collateral may include real property, vehicles, savings, or other assets acceptable to the surety company and agent. The specific collateral requirements, terms of use, and return conditions will be documented in your bail bond agreement.

If the defendant fails to appear in court, the court may order the bail forfeited. The co-signer and any collateral provider may become responsible for the full bail amount plus recovery costs. State law provides procedures and deadlines for reinstating or setting aside a forfeiture in some circumstances; consult your attorney immediately if a court date is missed.

7. NO LEGAL ADVICE

Vanguard Bail Bonds is a bail bond agency, not a law firm. We are licensed bail agents, not attorneys. Any information provided through our website, contact forms, AI assistant, or in conversation with our staff is general information about the bail process and is not legal advice. For legal advice specific to your situation, please consult a licensed criminal defense attorney in your jurisdiction.

8. RELEASE TIMELINES & LIMITATIONS

We commit to posting bonds promptly and accurately, but we cannot guarantee a specific release time. After a bond is accepted, jail or detention facility staff must complete their own procedures—verifying paperwork, checking for holds, completing processing, and discharging the individual. These timelines are controlled by the facility and may be affected by staffing, booking volume, shift changes, medical clearance, court orders, or case complexity. We are not liable for delays caused by the jail, court, or other governmental authorities.

9. WEBSITE USE & ACCEPTABLE USE

You agree to use our website only for lawful purposes. You agree not to: use the site in any way that violates applicable law; impersonate any person or entity; submit false, inaccurate, or misleading information through our forms; attempt to gain unauthorized access to any portion of the site; use automated tools or bots to extract data without our written permission; or use the site to solicit bail services in violation of state solicitation laws.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Vanguard Bail Bonds and its officers, agents, employees, and surety partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of our website or Services. We do not warrant that our website will be uninterrupted, error-free, or free of harmful components. Some states do not allow certain liability exclusions, so some limitations may not apply to you.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Vanguard Bail Bonds and its officers, agents, employees, and surety partners from and against any claim, liability, loss, damage, or expense (including reasonable attorney’s fees) arising out of or related to your use of our website or Services, your violation of these Terms, your violation of any law or the rights of any third party, or any false or misleading information you provide to us.

13. GOVERNING LAW & DISPUTE RESOLUTION

These Terms and any dispute arising out of or related to them shall be governed by the laws of the State of California for transactions originating in California and the laws of the State of Minnesota for transactions originating in Minnesota, without regard to conflict of law principles. Bail bond transactions are also subject to the insurance laws of the state in which the bond is posted.

You and we agree to attempt to resolve any dispute informally first. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in the state where the bond was posted, in accordance with the rules of the American Arbitration Association, except where prohibited by law.

14. CHANGES TO THESE TERMS

We reserve the right to revise these Terms at any time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of our website or Services after any change constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
